The Full Bench of the Fair Work Commission has decided to partially uphold an appeal of the ASU against a decision of Vice President Watson in relation to the above modern award.

The decision has the effect of varying the modern award to ensure that casual employees received the same penalties and overtime payments as full-time and part-time employees working on weekends and in excess of the ordinary hours. Casual employees working on Saturday and Sundays will be entitled to the weekend penalties only. They are not entitled to the casual loading in addition to the weekend penalty. All hours of work in excess of 38 hours in a week or 76 hours in a fortnight will attract the overtime penalties whether the employee is full-time, part-time or casual.
